1. Overview

This website and online store are operated by Rachel’s Keepsakes. Throughout these Terms of Service, “we”, “us” and “our” refer to Rachel’s Keepsakes.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our digital products.

By accessing our website or purchasing a product, you agree to these Terms of Service, our Privacy Policy and our Return and Refund Policy.

If you do not agree with these terms, you should not use our website or purchase our products.

2. Eligibility and customer information

You must be at least 18 years old, or the age of majority where you live, to make a purchase.

You agree to provide accurate and current information when placing an order. You are responsible for ensuring that your email address is correct so that order confirmations and digital access instructions can be delivered.

If you create a customer account, you are responsible for maintaining the security of your account and password.

3. Our digital products

Rachel’s Keepsakes sells editable digital Canva templates for funeral and memorial stationery.

No physical product will be posted or delivered unless a product listing expressly states otherwise.

Product photographs, names, dates and wording shown in previews are examples only and are not supplied as personalised customer content.

We take reasonable care to describe and display our products accurately. Colours may appear differently depending on your screen, printer, paper, ink and print settings.

4. Canva requirements

Our templates are designed to be edited using Canva. A Canva account, compatible device and internet connection are required.

Unless a product description states otherwise, our templates are designed to work with a free Canva account. Some optional Canva features, graphics or fonts may require Canva Pro if you choose to add them yourself.

Rachel’s Keepsakes is an independent business and is not affiliated with, sponsored by or endorsed by Canva. Your use of Canva is also subject to Canva’s own terms and policies.

We are not responsible for Canva outages, account restrictions, software changes or technical issues outside our reasonable control. If you experience difficulty accessing one of our template links, please contact us so we can investigate.

5. Template licence

Unless the product listing states otherwise, each purchase grants you a limited, non-exclusive and non-transferable licence to use the purchased template for one funeral or memorial service.

You may:

Edit the wording, names, dates, photographs, fonts and colours
Download the completed design as a PDF or other available format
Print a reasonable number of copies for that funeral or memorial service
Send the completed file to a printer for printing
Share the completed, personalised document with the family or people involved in that service

A funeral professional may use a purchased template for one client’s funeral or memorial service. A separate purchase is required for each additional client or service.

You must not:

Share, sell, transfer or distribute the editable Canva template link
Resell, sublicense or give away the template
Reuse one purchase for multiple funerals or clients
Claim the original template design as your own
Copy the design to create products for sale
Upload the template to another marketplace, website or file-sharing service
Use any part of the template to create a competing template
Remove watermarks from preview images for unauthorised use
Make the editable template available to any other person except as reasonably required to complete the single licensed service

Purchasing a template gives you permission to use it under this licence. It does not transfer ownership or copyright in the original design.

6. Photographs and customer content

You are responsible for ensuring that you have permission to use all photographs, names, music, poems, readings, text and other material that you add to a template.

You must not use our products to create content that is unlawful, threatening, discriminatory, defamatory, deliberately misleading or that infringes another person’s copyright, privacy or other legal rights.

Rachel’s Keepsakes is not responsible for content added to a template by a customer.

7. Orders and payments

When you place an order, you are offering to purchase the selected product. An order is accepted when payment has been successfully processed and an order confirmation is issued.

All prices are displayed in Australian dollars unless otherwise stated. Applicable taxes will be shown at checkout where required.

As our products are digital, no shipping fee applies.

Payments are processed securely through Shopify Payments, PayPal or another payment provider displayed at checkout. We may cancel or refund an order if we reasonably believe it is fraudulent, unauthorised, affected by a pricing error or in breach of these Terms.

8. Digital delivery and download access

After successful payment, your digital product or access instructions will be provided through the order confirmation page, email or digital delivery service.

Please check your email address carefully before completing your order. If the email does not arrive, check your spam or junk folder before contacting us.

Download access may be limited to four download attempts. You are responsible for downloading your files promptly and keeping a secure backup.

We may assist with a lost or expired access link where reasonably possible, but we cannot guarantee indefinite access to previously purchased files or third-party platforms.

You must not share your download email, files or editable template link with anyone who is not involved in completing the licensed funeral or memorial service.

9. Editing and printing responsibility

Our products are editable templates. You are responsible for:

Entering names, dates and other details correctly
Checking spelling, grammar and formatting
Confirming that photographs are clear and suitable for printing
Reviewing every page before downloading or printing
Selecting suitable paper, print settings and finishing options
Obtaining a printer’s proof where appropriate

Rachel’s Keepsakes is not responsible for errors introduced during customer editing, differences caused by a printer or printing costs resulting from a customer-approved error.

Nothing in this section limits any rights you may have if the original product supplied by Rachel’s Keepsakes is faulty or does not match its description.

10. Refunds and consumer rights

Because our products are supplied digitally, we generally do not provide returns, exchanges or refunds for change of mind after the digital files or template access link have been supplied.

Refunds and remedies are handled in accordance with our Return and Refund Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable law that cannot legally be excluded.

11. Intellectual property

The website, branding, logos, written content, product descriptions, graphics, preview images and original template designs are owned by or licensed to Rachel’s Keepsakes and are protected by applicable intellectual property laws.

Canva elements, fonts, photographs or other third-party materials remain the property of their respective owners and may be subject to separate licence terms.

You may not reproduce, scrape, republish, distribute or commercially exploit our website content or product designs without prior written permission.

12. Third-party services and links

Our website and products may contain links to services operated by third parties, including Shopify, Canva and payment providers.

We are not responsible for the availability, security, content or privacy practices of third-party services. Your use of those services is governed by their own terms and policies.

Please review the relevant third-party terms before using their services.

13. Relationship with Shopify

Rachel’s Keepsakes is powered by Shopify, which enables us to provide the services to you. However, any sales and purchases you make through our store are made directly with Rachel’s Keepsakes.

By using the services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Rachel’s Keepsakes, including any injury, damage or loss resulting from purchased products or services.

You release Shopify and its affiliates from claims, damages and liabilities arising from or relating to purchases and transactions with Rachel’s Keepsakes, to the extent permitted by applicable law.

14. Privacy

Personal information collected through our website is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify also collects and processes certain information relating to your use of the website and checkout. You can read the Shopify Consumer Privacy Policy for more information.

15. Reviews and feedback

If you submit a review, testimonial, suggestion or other feedback, you confirm that the content is truthful, lawful and based on your own experience.

You give Rachel’s Keepsakes permission to display and use that feedback for operating, improving and promoting the business. We will not publish private information such as your email address without permission.

We may remove feedback that is unlawful, abusive, misleading, offensive, fraudulent or infringes another person’s rights.

16. Prohibited use

You must not use our website or products:

For an unlawful or fraudulent purpose
To infringe our intellectual property or another person’s rights
To introduce viruses, malware or harmful code
To collect another person’s personal information without authority
To send spam or misleading communications
To interfere with the security or operation of the website
To gain unauthorised access to customer accounts or store systems
To copy, scrape or extract our products or website content
To impersonate another person or provide false information

We may suspend access, cancel an order or take appropriate action if these Terms are breached.

17. Errors and availability

We may correct errors or update product descriptions, prices, images and other website information when necessary.

We may change, suspend or discontinue a product. Changes will not remove a customer’s rights relating to a purchase already completed.

If a pricing or technical error affects an order, we will contact you and provide an appropriate correction or refund.

18. Disclaimer and limitation of liability

We aim to keep our website and digital products accurate, secure and available. However, we cannot guarantee that the website or third-party services will always operate without interruption or technical difficulty.

To the extent permitted by law, Rachel’s Keepsakes is not responsible for indirect or consequential loss arising from:

Customer editing mistakes
Printing decisions or third-party printing services
Loss of files after they have been successfully delivered
Sharing of template links or account credentials
Canva, Shopify or payment-provider interruptions outside our control
Use of a product for a purpose not described in its listing

This section does not exclude or limit liability that cannot legally be excluded, including rights and remedies under the Australian Consumer Law.

19. Suspension and termination

We may suspend or terminate access to our website or digital products if we reasonably believe these Terms have been breached, including through unauthorised copying, sharing or resale.

Terms relating to intellectual property, template licensing, liability and governing law continue to apply after termination.

20. Governing law

These Terms are governed by the laws of Western Australia and the applicable laws of Australia.

Any dispute will be subject to the jurisdiction of the courts and tribunals of Western Australia, except where applicable consumer law gives a customer the right to bring proceedings elsewhere.

21. Changes to these Terms

We may update these Terms to reflect changes to our products, services, legal obligations or business practices.

The current version will be published on this website with an updated revision date. Changes will not retrospectively remove rights relating to purchases already completed.
